Event Terms and Conditions

Hi! We’re excited to have you join us Hype Hotel 2015 (the “Event”). Please read the Event Registration Terms and Conditions below and our Privacy Policy carefully.

The Event is organized by The Hype Machine, Inc, (“Hype Machine” or “Us”), and we reserve the right, in our sole discretion, to limit or deny access to any individual. To be eligible to attend the Event, you must: (a) have submitted a valid RSVP to us prior to your arrival at the Event or be holding a valid SXSW credential; and (b) be 21 years or older (or a minimum age that we otherwise designate) and provide valid proof of government issued identification at the time of entry. By attending the Event, you agree to abide by all generally applicable rules and regulations governing your Event that have been provided or otherwise made known to you at the Event.

By attending the Event, you acknowledge that you may appear in photos and/or videos taken by Hype Machine, its affiliates, contractors, vendors, or marketing partners recorded or captured at the Event (“Media”). Hype Machine may use the Media and your likeness, image, body, appearance, and/or any other visual aspects of your person that appear in the Media in all kinds of media and technology worldwide. Hype Machine may use the Media in any way, including but not limited to making amendments and adaptations to them and combining them with other content. Hype Machine may license, sublicense, and/or assign its rights hereunder and to the Media to other parties. Any and all rights in the Media, including, but not limited to, copyright, shall belong to Hype Machine or its designated party. Hype Machine may share the Media in a variety of traditional and social media and technology, including, but not limited to, Facebook, Twitter, the Hype Machine web page, or other places Hype Machine chooses. The Media may be used in connection with the Event or in connection with Hype Machine’s business and services. The Media may be used in advertising or marketing materials. You’re not being paid to appear in the Media, but your participation in the Event is good and valuable consideration for your appearance in the Media. Hype Machine will expend time and incur costs in reliance upon your agreement to these Event Terms and Conditions.

These Event Registration Terms and Conditions shall be subject to New York state law and any disputes arising out of or in connection with this Release Form shall be subject to the exclusive jurisdiction of the state and federal courts in New York, New York.

Everything regarding the event, including this RSVP page, is provided “as is” without any warranty of any kind, either express or implied, including but not limited to, the implied warranties of merchantability, fitness for a particular purpose or non-infringement. To the fullest extent permitted by low, in no event will Hype Machine, its officers, shareholders, employees, agents, directors, subsidiaries, affiliates, successors, assigns, suppliers, or licensors will be liable for any indirect, special, incidental, punitive, exemplary, or consequential damages, arising out of the event, regardless of legal theory, without regard as to whether Hype Machine has been warned by the possibility of those damages, and even if a remedy fails of its essential purpose.
